Following the receipt of a Notice as explained below, we will determine the appropriate action, in our sole discretion, which may include the removal of the content in question from the Site.

DMCA Notice of Alleged Infringement ("Notice")

1. Specify the copyrighted work you claim is being infringed, or - if this Notice covers multiple copyrighted works - you may submit a representative listing of the copyrighted works alleged to be infringed.
2. Identify the material or link that you believe is infringing (or is the subject of infringing activity) and needs to be disabled, including, at a minimum, if relevant, the URL of the link displayed on the Site or the exact location where such material is found.
3. Provide your company affiliation (if any), mailing address, phone number, and, if available, email address.
4. Include both of the following declarations in the Notice:
* "I affirm that I have a genuine belief that the contested use of the copyrighted material is not sanctioned by the copyright owner, its representative, or the law (e.g., as a fair use)."
* "I affirm that the information provided in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of, the owner, of the copyright or an exclusive right under the copyright that is allegedly being infringed."
5. Give your full legal name and your electronic or physical signature.

It is important to note that under Section 512(f) of the DMCA, anyone who knowingly misrepresents that material or activity is infringing may be liable for damages.

Counter-Notification

If you believe that your content that was removed (or access to which was disabled) is not infringing, or that you have permission from the copyright holder, the copyright holder's agent, or under the law, to publish and utilize the content, you may submit a counter-notice containing the following details to our Designated Copyright Agent:

1. Your physical or electronic signature;
2. Identification of the content that was taken down or to which access was impeded and the location where it was available before removal or disablement;
3. A statement asserting that you have a good faith belief that the content was removed or disabled due to an error or misidentification of the content; and
4. Your name, address, phone number, and email address, a statement indicating your consent to the jurisdiction of the federal court in Seychelles, and a statement that you will accept service of process from the individual who provided the notification of the alleged infringement.

If our Designated Copyright Agent receives a counter-notice, we may notify the original complainant of the counter-notice and inform them that we might restore access to the content or cease disabling it in 10 business days. Unless the copyright owner initiates an action seeking a court order against the content provider or user, the removed content may be reinstated or access to it allowed within 10 to 14 business days or longer at our discretion.

Repeat Infringer Policy

In alignment with the DMCA and relevant laws, we have established a policy of terminating, under appropriate circumstances and at our sole discretion, the accounts of users identified as repeat infringers. We also retain the right, at our sole discretion, to limit access to the Site and/or terminate the accounts of any users who infringe upon the intellectual property rights of others, regardless of whether the infringement is repeated.
